Legal Update on Roles and Responsibilities of Administrative Commune and Sangkat on Land Registration in Cambodia

Roles and Responsibilities of Administrative Commune Sangkat on Land Registration, “administrative commune and sangkat shall be certified on any letters for land un-registration (soft-title) and carefully focuses and responsibilities on identification of land which is subjected for contracting letter and identification of the parties of the contracting only” based on New Article 9 (i) as mentioned in the Joint-Prakas No. 046 Pra/MLMUPC/MI dated 9th July, 2025 on modification of new article 9 of Joint-Prakas No. 215 Pra/MLMUPC/MI dated 31st September, 2005 of Minister of Land Management, Urban Planning and Construction and Minister of Interior on Roles and Responsibilities of Administrative Commune and Sangkat on Land Registration.  

Whereas, VENTE DEFINITIVE, DONATION DEFINITIVE, Agreement on Pledge, Agreement on Hypothec, or other letters for land registration completely (Hard Title); shall be under certified by cadastral official of Municipal/Provincial Department of Land Management, Urban Planning, Construction, and Cadaster or Cadastral Official of City/ District/Khan Office of Land Management, Urban Planning, Construction and Land.

Cadastral Official of Municipal/Provincial Department of Land Management, Urban Planning, Construction, and Cadaster or Cadastral Official of City/ District/Khan Office of Land Management, Urban Planning, Construction and Land maybe also certified on Agreement on Perpetual Lease Right, Usufructuary Right, and Easement Right in case of the parties consented together under the form of authentic act.          

So, for any certification on the letters, Cadastral Official of Municipal/Provincial Department of Land Management, Urban Planning, Construction, and Cadaster or Cadastral Official of City/ District/Khan Office of Land Management, Urban Planning, Construction and Land shall be carefully focused and responded on such as;

  • Identification of property that is subjected of contracting letter, and
  • Identification of the contracting's parties,

In pursuant with New Article 9 (i) as mentioned in the Joint-Prakas No. 046 Pra/MLMUPC/MI dated 9th July, 2025 on modification of new article 9 of Joint-Prakas No. 215 Pra/MLMUPC/MI dated 31st September, 2005 of Minister of Land Management, Urban Planning and Construction and Minister of Interior on Roles and Responsibilities of Administrative Commune and Sangkat on Land Registration.
